Thank you for looking at our light fixtures! We hope to sell you a light fixture that you will love and use for many years to come!
PLEASE TAKE A FEW MINUTES TO REVIEW THESE TERMS AND CONDITIONS (“TERMS”). THESE TERMS APPLY TO YOUR ACCESS AND USE OF LONGMADECO.COM (“SITE”). THESE TERMS CONTAIN VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. BY PLACING AN ORDER FOR PRODUCTS OR SERVICES FROM OUR SITE, YOU ACCEPT AND ARE BOUND BY THESE TERMS AND CONDITIONS.
These Terms apply to the purchase and sale of products (“Products”) and services through our Site. These Terms are subject to change by Long Made (referred to as “us”, “we”, or “our” as the context may require) without prior written notice at any time, in our sole discretion. The current version of these Terms is indicated above.
We reserve the right to change or modify these Terms at any time and at our sole discretion. If we make changes to these Terms, we will provide notice of such changes, such as by posting a notice on the Site and/or updating the “Last Updated” date above. Your continued use of this Site after a posted change in these Terms will constitute your acceptance of and agreement to such changes. If you do not agree to the amended Terms, you must stop using the Site.
Technical Specifications:
While all of our Products are made with UL-approved light sockets, the finished Products themselves are not UL-listed unless otherwise noted. Certain Products can be UL-listed, as noted in their description, as an extra service upgrade for projects that require it. Not all projects require it, so we do not offer the UL-listed status automatically. All of our Products are for indoor dry locations only. Only use LED 11 watt max bulbs in our Products. Standard incandescent bulbs can get too hot for our Products and shades. The use of standard incandescent bulbs may damage our Products or be too hot to touch, and even be a fire hazard.
Intellectual Property:
The Site, including all of its information and content such as photographs, images, text, data, wallpapers, icons, characters, artwork, graphics, page layout, form, music, sound, messages, software and the code used to generate the pages on the Site (collectively, the “Materials”), is the property of Long Made, and is protected under worldwide patent, copyright, trademark, trade dress, and other laws, whether under statutory or common law. Except as otherwise provided on the Site or in these Terms, you may not download, upload, copy, print, display, reproduce, publish, license, post, distribute, or otherwise use any Materials from the Site in whole or in part for any public or commercial purpose without specific prior written permission from Long Made. You hereby agree to indemnify Long Made in the event of any breach of intellectual property rights by or through your use of the Site and any content contained therein (or other Materials as set forth above).
Use of the Site:
You agree to use the Site for your personal use only and shall in no event use any of the information, text, images, graphics, directories, files, databases, listings etc. obtained on or through the Site for commercial purposes of any sort, nor for copying, reproducing, downloading, compiling whether directly, indirectly. Use of any content on the Site for purposes other than as permitted in these Terms is prohibited.
Merchandise and Orders:
Long Made reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any customer. Verification of information may be required prior to the acceptance of an order, and to the extent this includes personal information, such personal information will be processed in accordance with our Privacy Statement.[1] All prices displayed on this site are quoted in U.S. dollars and are valid and effective only in the United States. All prices and availability are subject to change without notice.
Delivery:
Delivery timeframes communicated by Long Made are estimates and dependent on many factors beyond its control, including but not limited to production delays, shipping delays, government delays and forces of nature. Under no circumstances will we be held liable for any delay or failure in performance due in whole or in part to any acts of nature or other causes beyond our reasonable control.
Order Returns/Cancellations:
We accept returns and exchanges so you can order with peace of mind. However, since all of our Products are made to order just for you, (i) orders of five or more items or custom fixtures and (ii) previously install fixtures are non-returnable. We will accept a return of qualifying Products for a refund of your purchase price, less the original shipping and handling costs, provided such return request is made within 15 days of delivery and provided such Products are returned in their original condition within 30 days of delivery.
You are responsible for all shipping and handling charges on returned items. You bear the risk of loss during shipment. We therefore strongly recommend that you fully insure your return shipment against loss or damage and that you use a carrier that can provide you with proof of delivery for your protection. All returns are subject to a 15% restocking fee.
If a cancellation is needed, please contact us within 24 hours of placing your order.
Limited Warranty:
We pay great attention to detail and use only the highest quality parts in our Products. Each Product is made by hand and is tested and inspected before being shipped to you. While our Products can be found in hundreds of homes, cafes, bars, and retail stores around the world, and while we take great pride in the quality and safety of our Products, they are not UL listed and it is your responsibility to check with a building contractor or local electrical inspector for approval before use. Long Made guarantees to the original purchaser that, at the time of delivery, our Products are free from defects in materials and workmanship. In the rare event your product arrives damaged, we will fix the issue at no cost to you. However, please keep original packaging and contact us within 24 hours of delivery. We may need photos of the boxes and product to file a claim with Fedex, USPS or UPS.
Long Made hereby disclaims all other warranties of any kind, whether express or implied, statutory or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose. The foregoing does not affect any express warranties made by Long Made or warranties which cannot be excluded or limited under applicable law. The informal dispute resolution procedure detailed below is available to you if you believe that we have not performed our obligations under this limited warranty or these Terms.
Limitation of Liability:
THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT THAT YOU HAVE PURCHASED THROUGH THE SITE, NOR WILL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY LOSS OF PRODUCTION, WORK, DATA, USE, BUSINESS, GOODWILL, REPUTATION, REVENUE OR PROFIT, ANY DIMINUTION IN VALUE, COSTS OF REPLACEMENT GOODS OR SERVICES, OR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
Notice to California Residents:
California Proposition 65 entitles California consumers to special warnings for products that contain chemicals known to the State of California to cause cancer and birth defects or other reproductive harm if such products expose consumers to such chemicals above certain threshold levels. We care about our customers’ safety and hope that the information below helps with your buying decisions.

Other Provisions:
Governing Law and Jurisdiction. These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of laws provisions. To the extent any action relating to the use of the Site or any transaction with Long Made is not required to be arbitrated or filed in small claims court in accordance with the arbitration provision below, such action must be brought in the state or federal courts located in the Harris County, Texas, and you hereby irrevocably consent to the personal jurisdiction of such courts for the purposes of any such action.
Information Dispute Resolution. We try to address any disputes without the need to initiate a formal legal case. You agree that prior to submitting any dispute or claim to arbitration for resolution, you and we agree to make a good faith effort to resolve it informally, including having at least one telephone or videoconference conversation between you, personally, and us.
Arbitration (for individuals residing in the United States):
YOU AND LONG MADE ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION. ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS OR SERVICES THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.
The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified herein. The AAA Rules are available at adr.org or by calling the AAA at 1-800-778-7879. The Federal Arbitration Act will govern the interpretation and enforcement of this section.
The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the Terms are void, voidable or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.
You may elect to pursue your claim in small-claims court rather than arbitration if you provide us with written notice of your intention do so within 60 days of your purchase. The arbitration or small-claims court proceeding will be limited solely to your individual dispute or controversy.
You agree to an arbitration on an individual basis. In any dispute, neither you nor Long Made will be entitled to join or consolidate claims by or against other customers in court or in arbitration or otherwise participate in any claim as a class representative, class member or in a private attorney general capacity. The arbitral tribunal may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.
Severability. If any provision of these Terms, or a portion thereof, is found to be unlawful or unenforceable, then that provision will be deemed severable from these Terms and will not affect the enforceability of any remaining provisions of these Terms, which shall continue in full force and effect.
No Waivers. The failure by us to enforce any right or provision of these Terms will not prevent us from enforcing such right or provision in the future. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Long Made.
Assignment. We may assign our rights and obligations under these Terms, including in connection with a merger, acquisition, sale of assets or equity, or by operation of law.
Entire Agreement. These Terms constitute the entire agreement between you and Long Made with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. The section headings used herein are for convenience only and shall not be given any legal import.
Privacy Statement
Through this website, you will be able to purchase Long Made Co., LLC (“Long Made”) products. We ask for information such as your name, billing and shipping address, telephone number, email address and payment card information in order to process your purchase, confirm your order and ship the items to you. If you elect to be added to the Long Made email list, we may use your contact information to communicate with you about our products, services and promotions.
You have the opportunity to create a personal shopping account with Long Made, which allows you to shop faster and easier. Using a user name and a password of your choice, you may access your account online at any time to add, delete, or change information. In creating this account, you authorize Long Made to store your name and email address. Should you elect to do so, you may also include in your “My Account” your telephone number, payment card information, and shipping and billing addresses. If you choose to include such additional information then you are also authorizing Long Made to store such information until such time you elect to change or delete it. Each of these options is for your convenience only.
Like most websites, we use automatic data collection technology when you visit our Site to record information that identifies your computer, to track your use of our Site, and to collect certain basic information about you and your surfing habits. This information includes information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit, and similar information concerning your use of the Site and the Service.
Additionally, like most websites, our Shopify websites use cookies to collect information via Shopify. Cookies are small data files which are placed on your computer or other devices (such as smartphones or tablets) as you browse our websites. They are used to ‘remember’ when your computer or device accesses our websites. They allow computers to remember whether you are logged in to the site and what items you had in your shopping basket. Cookies are essential for the effective operation of our website and to help you shop online. They are also used to tailor the products and services offered and advertised to you, both on our websites and elsewhere.
If you have elected to provide us with your contact information, e.g., by registering at the Site, emailing our Customer Service department or placing an order, we may provide you with service related announcements concerning the Site or contact you regarding our customer service requests or your order. For example, all registered users may receive a welcoming email to confirm their registration. These types of communications are necessary to serve you, respond to your concerns and to provide the high level of customer service.
Further, when you place an order on our website you will make payment for the goods or services you have ordered. In order to process your payment we use a third party payment processor (Shopify Payments) and their fraud gateway to ensure that your order is not fraudulent. Your payment will be processed by Shopify Payments. Shopify collects, uses and processes your information, including payment information, in accordance with their privacy policies. You can access their privacy policy off their website at Shopify.com.

Long Made Co., LLC ("Long Made”, “us”, “we”, or “our”) cares about your privacy. When you interact with us or LongMadeCo.com (“Site”), we may collect certain personal information about you. This privacy policy (“Policy”) describes how we collect, use, disclose, and otherwise process your personal information, and outlines certain privacy rights you may have with respect to your own personal information.
The Policy applies to you whenever you access or use the Site, and whenever you place an order for products or services with us (through the Site or otherwise). By accessing the Site or placing an order with us, you accept and are bound by this Policy.

We may need to verify your identity before fulfilling any privacy rights request, which may include asking you to provide certain personal information. If we are unable to verify your identity, we may deny your request. To the extent permitted under applicable law, you may designate someone as an authorized agent to submit requests and act on your behalf with respect to your personal information.
We will respond to all valid privacy rights requests in accordance with our legal obligations. However, we reserve the right to decline your request as permitted by law. If we decline your request, you may have the right to appeal our decision, depending on your jurisdiction of residence. To appeal, you may respond to us stating your intent to appeal our decision, and we will provide further instructions.

If you have elected to provide us with your contact information, e.g., by registering at the Site, emailing our Customer Service department or placing an order, we may provide you with service-related announcements concerning the Site or contact you regarding our customer service requests or your order. For example, all users will receive an email confirmation after completing an order. These types of communications are necessary to serve you, respond to your concerns and to provide the high level of customer service. If you do not wish to receive promotional emails from us, you may click “Unsubscribe” at the bottom of the email or Contact Us below. Even if you unsubscribe from promotional emails, you will still receive necessary functional emails related to your account, orders, and customer service inquiries.

Our Site contains links to third-party websites. If you choose to click on one of these links, you will be directed to that third party's website. The fact that we link to a website is not an endorsement, authorization, or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. Neither Long Made products nor the Site are intended for use by minors under the age of 16, and we do not knowingly solicit any information from or market to such minors. If you are a parent or legal guardian who discovers that your child has provided us with their personal information without your consent, please contact us below. If we discover that we have obtained personal information of a minor without parental or legal guardian consent, we will delete it from our systems.
Changes:
We reserve the right to change or modify this Policy at any time and at our sole discretion. If we make changes to this Policy, we will provide notice of such changes, such as by posting a notice on the Site and updating the “Last Updated” date above. Your continued use of this Site after a posted change in the Policy will constitute your acceptance of and agreement to such changes.
